How to Create a Puppy Sales Contract: A Breeder's Complete Guide
Why Every Breeder Needs a Written Contract
A puppy sales contract is a legally binding agreement between you (the breeder) and the buyer that defines the terms of the sale, health guarantees, and expectations for both parties. Without a contract, misunderstandings about health warranties, return policies, and breeding rights can escalate into costly disputes.
Whether you sell one litter a year or manage a large program, a well-written contract is the foundation of professional, transparent puppy sales.
What to Include in a Puppy Sales Contract
A complete contract should cover the following sections:
1. Breeder & Buyer Information
- Full legal name and address of the breeder
- Full legal name and address of the buyer
- Date of the agreement
- Contact information for both parties (email, phone)
2. Puppy Identification
- Breed, color, sex, and date of birth
- Registered name (if applicable) and registration number
- Microchip number
- Sire and dam names with registration numbers
- Litter identification or call name
3. Purchase Price & Payment Terms
- Total purchase price
- Deposit amount and whether it is refundable or non-refundable
- Balance due date (typically at pickup)
- Accepted payment methods
- Any payment plan terms (if offered)
4. Health Guarantee
The health guarantee is often the most important section of the contract. It should clearly state:
- The duration of the guarantee (commonly 1–2 years for genetic conditions)
- What conditions are covered (hip dysplasia, heart defects, hereditary eye diseases, etc.)
- What conditions are NOT covered (injuries, infections, conditions caused by neglect or overfeeding)
- The remedy offered (replacement puppy, partial refund, or veterinary cost reimbursement up to a limit)
- Requirements for a claim (veterinary examination by a licensed vet, written documentation, notification within a specified timeframe)
Be specific. Vague language like "health guarantee for life" without defined terms is unenforceable and sets unrealistic expectations.
5. Spay/Neuter Requirements
- Whether the puppy is sold on a limited or full registration
- If limited registration: at what age must the dog be spayed/neutered
- Consequences for non-compliance (e.g., registration revocation, penalty fees)
- Option to upgrade to full registration and under what conditions (show/breeding prospects)
6. Return & Rehoming Policy
- Your policy if the buyer can no longer keep the dog (first right of refusal is standard for responsible breeders)
- Whether the buyer may rehome the dog independently or must return it to you
- Any refund terms for returned dogs
- Your policy for the first 48–72 hours after pickup (some breeders allow a short return window if the puppy does not pass a vet check)
7. Breeder Responsibilities
- Providing current vaccination records
- Providing deworming history
- Providing health testing documentation for sire and dam
- Providing registration paperwork or transfer
- Microchipping the puppy before delivery
- Socializing the puppy appropriately before go-home day
8. Buyer Responsibilities
- Scheduling a veterinary wellness exam within 48–72 hours of pickup
- Providing appropriate nutrition, exercise, and veterinary care
- Completing the recommended vaccination and preventive care schedule
- Not breeding the dog without written consent (if sold on limited registration)
- Notifying the breeder if the dog develops a health issue covered by the guarantee
- Never surrendering the dog to a shelter or rescue without contacting the breeder first
9. Shipping & Delivery Terms
If you ship puppies or use a flight nanny:
- Who pays for shipping costs
- The carrier or delivery method
- At what point does responsibility transfer to the buyer (typically upon delivery)
- Travel crate and health certificate requirements
10. Signatures
Both parties must sign and date the contract. E-signatures are legally valid in all 50 U.S. states under the ESIGN Act and UETA.
Digital Contracts vs. Paper Contracts
Paper contracts get lost. Digital contracts do not. Moving to digital contracts offers several advantages:
- E-signatures — Buyers can sign from anywhere, on any device
- Automatic storage — Both parties have access to the signed document indefinitely
- Faster turnaround — No printing, scanning, or mailing
- Professionalism — A polished digital contract signals a serious, organized operation
BreederCloudPro lets you build custom contracts, send them to buyers for e-signature, and store everything in one place. Signed contracts are automatically accessible to buyers through their Pet Portal.
Common Mistakes to Avoid
- Being too vague — "Health guarantee included" means nothing without specifics. Define what is covered, for how long, and what the remedy is.
- Not requiring a vet check — Require the buyer to take the puppy to a vet within 48–72 hours. This protects you from claims that arise months later.
- Skipping the return clause — Without first right of refusal, your puppy could end up in a shelter.
- Using a one-size-fits-all template — Different situations may require different contracts (pet vs. show/breeding, domestic vs. shipped).
- Not having both parties sign — An unsigned contract is just a piece of paper.
State-Specific Puppy Lemon Laws
Several states have "puppy lemon laws" that provide additional buyer protections beyond your contract. These laws may require breeders to offer refunds, replacements, or veterinary reimbursement if a puppy is found to have a congenital or hereditary defect within a specified period. States with puppy lemon laws include California, New York, New Jersey, Connecticut, Florida, Virginia, Pennsylvania, and others.
Review the laws in your state and any state where you sell puppies to ensure your contract is compliant.
Getting Started
A well-crafted contract protects your business, sets clear expectations, and builds buyer confidence. If you already have a contract, review it annually to ensure it reflects your current policies and any legal changes. If you do not have one yet, start now — it is one of the most important investments you can make in your breeding program.
