This is an agreement between Elhart or (EK9) and the pet owner whose signature appears below (the “Owner”).

1. Owner agrees to pay the rate in effect on the date the pet is checked into EK9.

2. Owner agrees to pay all costs and charges for special services requested and all veterinary costs incurred while the pet is in the care of EK9.

3. Owner agrees that the pet shall not leave the facility until all charges due are paid, or unless other payment arrangements are agreed upon by both parties. A charge of $35 will be added to any checks that are returned for insufficient funds.

4. All charges incurred by Owner for boarding are payable upon pickup or delivery of the pet. EK9 shall have and is hereby granted a lien on pet for any and all unpaid charges resulting from services provided by EK9. Owner agrees that in the event charges are not paid when due in accordance with this contract, EK9 may exercise its lien rights upon 10 days written notice given by EK9 to Owner via certified mail at address shown on contract. EK9 may dispose of the pet for any and all unpaid charges at private or public sale in the sole discretion of EK9, and the owner waives all statutory or legal right to the contrary. If such sale does not secure a price adequate to pay delinquent charges, the Owner shall be liable to EK9 for the difference. All monies received by EK9 at such sale over and above charges due and costs of sale shall be paid to Owner.

5. Owner agrees that any belongings left with the pet are left at will and EK9 is not responsible for lost or damaged items.

6. If the pet becomes injured or ill, or if the state of the pet’s health otherwise requires professional attention, EK9 in its sole discretion may engage the services of a veterinarian or administer medicine or give other requisite attention to the pet. These expenses will be the responsibility of Owner.

We will attempt to contact your emergency number which must be provided upon check in. The emergency contact person must be an adult, capable of making decisions for you regarding your pet’s health and able to be reached within Canada. Please note that whomever you choose as your emergency contact, they are authorized to make medical decisions for you pet.

Should a life threatening (critical) medical condition occur during their stay and attempts to reach your emergency contact are unsuccessful, medical decisions regarding your pet’s health will be made by the doctor on duty.

7. Owner certifies the accuracy of all information given on this form. EK9 reserves the right to deny admittance to Owner’s pet at any time for any reason.

8. EK9 shall exercise all reasonable care for pet during its stay. It is expressly agreed by Owner and EK9 that EK9’s liability shall in no event exceed the lesser of the current chattel value of a pet of the same species of $400.00 per pet. The Owner further agrees to be solely responsible for any and all acts of behavior of the pet during pet’s stay at EK9, to include payment and costs for injury to staff or other animals and damage to the facility caused by the pet.

9. Owner represents that he or she is the sole owner of the pet, free and clear of all liens and encumbrances.

10. Owner represents to EK9 that the pet has not been exposed to any contagious diseases within a 30-day period prior to check-in. Owner will be charged the current rate for a flea bath if the pet is found to have fleas at time of check-in. Owner also agrees to notify EK9 of any known exposure of the pet to a communicable disease, and not to board the pet until it is symptom-free for a minimum of 10 days or with written veterinary clearance. Owner agrees to maintain current vaccinations required by EK9’s policy.

11. Owner understands and agrees that during normal dog play, Owner’s dog may sustain injuries. All group dog play is monitored by staff, but scratches, punctures, torn ligaments, and other injuries may occur. EK9s is not liable for such injuries. No dog will be admitted to group play that shows any signs of aggression.

12. This contract contains the entire agreement between Owner and EK9. All terms and conditions of this contract shall be binding on the heirs, administrators, personal representatives, and assigns of the Owner and EK9.

If your pet is stressed or anxious due to the activities selected, we will attempt to substitute for another if possible. Your pet’s health and happiness are our primary concern.

13. Any controversy or claim arising out of or relating to this contract or the breach thereof, or as a result of any claim or controversy involving the alleged negligence by any party to this agreement, shall be settled in accordance with the rules of the Canadian Arbitration Association, and judgement upon the award rendered by an arbitrator may be entered in any court having jurisdiction thereof. The arbitrator shall, as part of the award, determine an award to the prevailing party of the costs of such arbitration and reasonable attorney’s fees of the prevailing party.
